Permitting Rules and Forms
Licensed Water Well Contractors
The Northwest
Florida Water Management District operates
regulatory programs that address through rules, the consumptive
use of water, the construction
of water wells and licensing of water well contractors,
the safety of nonagricultural impoundments, agricultural
and forestry surface water management
facilities including "farm ponds," the artificial
recharge of ground water, and works
of the District.
General examples of each program
and rule are listed here. This list is for public information purposes
only and does not constitute a complete listing of all possible permitting
situations.
For consumptive use permitting
purposes, the District is divided into three permitting areas; Permit
Areas A, B, and C. (See Permit Area Map
in Adobe Acrobat format). Unless exempted by law or rule, a consumptive
use permit is required for the following:
Ground Water Withdrawals
- Withdrawals which
exceed an annual daily average of 100,000 gallons; or
- Combined withdrawal
capacity of the well(s) exceeds 1,000,000 gallons a day; or
- Withdrawals from a
well(s) six-inches or larger in diameter; or
- Any withdrawal for
public supply use.

- Withdrawals which
exceed 1,400,000 gallons in any single day; or
- Withdrawals from a
well(s) ten-inches or larger in diameter; or
- Any withdrawal for
public supply use;.
Surface
Water Withdrawals (Regardless of Location)

- Withdrawals from a lake,
pond, river, stream, or impoundment which exceed an average daily
withdrawal of 100,000 gallons, or exceed 1,000,000 gallons on any
single day or 10 percent of the base flow of the supplying water
body; or

- In Gadsden County, in
addition to the above thresholds, surface water withdrawals using
a pipe(s) or combination of pipes whose outside diameter(s) equals
4 inches or larger; or
-
- Any withdrawal for public
supply use.

- A permit is required
for the construction, repair, or abandonment of any well constructed
in the District unless specifically exempted by rule or law.

- Water wells, including
monitor wells, must be constructed, repaired, or abandoned by a
Florida-licensed water well contractor.

- All abandoned wells
must be properly plugged, a permit obtained from the District, and
the work performed by a Florida-licensed water
well contractor.

- The District operates
a licensing and enforcement program for persons engaged in the water
well business. Anyone engaging in the business of water well construction,
repair, or abandonment must be a Florida-licensed water
well contractor.

- All wells must be finished
at least 12 inches above grade.

- A permit is required for
the construction, alteration, repairs, or abandonment of dams in excess
of 10 feet, or impounding more than 50 acre-feet, except those used
for agriculture or forestry which are covered under Chapter 40A-44,
Florida Administrative Code. Recreation and urban impoundments (man-made
ponds) and certain stormwater facilities are regulated by this rule.
- A permit is also required
for other water management facilities which reroutes, restricts, or
alters the rate of flow of watercourses from watersheds that exceed
five square miles.

- A permit is required
for the construction, alteration, repair, or abandonment of impoundments,
dams, or works which impound, drain, or divert water. Farm ponds
are regulated by this rule, but not aquaculture or recreation impoundments.

- Forestry activities
affecting the water resources of the District require an authorization
or a permit. These activities include roadways and ditches, culverts,
bridges, low water crossings and activities in wetland areas.

- The conversion of wetlands
by ditching or draining to other uses such as pasture, crop land
or pine plantation requires a permit.

- Permits are required for
activities on, or which may affect, facilities and lands owned and managed
by the District which have been designated as Works of the District.

- The Northwest Florida Water
Management District does not implement Florida's Environmental
Resource Permit (ERP) program. Section 373.4145, Florida Statutes, exempts
the District from the implementation of this program due to its limited
financial resources. The Florida Department of Environmental Protection
is responsible for all non-agricultural wetland related permits.
